1. What type of case should be served on the Prosecuting Attorney's Office?

Any case involving child support issues where the child has ever received TANF or medical benefits from the State AND current, future or past child support/debt will be addressed in the court action. It is better to serve the Prosecutor's Office if there is any question about whether to serve or not serve.

2. How to notify/serve the Prosecuting Attorney's Office.

You can drop the documents off in person, by mail, or fax.

3. If the Prosecutor's Office is served with documents do they always get involved?

No, each case is reviewed to see if the State has an interest in the case. The Prosecutor's Office will file a document in the court file to let the Court know if the State has an interest or not.

4. What does it mean, "the State has an interest in this case?"

An example of State's interest is: There may be a debt owed to the State because the child was on TANF. The deputy prosecutor will review the Order of Child Support to see that the debt is not extinguished in the Order.

If there is State interest the State/Prosecutor's Office will file a Notice of Appearance and Response.

If you receive a Notice of Appearance and Response from our office, from then on you should send a copy of everything you file in the court file, to the prosecuting attorney.
